Terms and Conditions Gift Card – Bij Daaf & Maan

These terms and conditions apply to the purchase and use of gift cards issued by Bij Daaf & Maan, located in Leiden (Nieuwe Rijn 49, 2312 JH), Chamber of Commerce (KVK) number: 42056564.

1. General

1.1 These terms and conditions apply to all physical gift cards issued by Bij Daaf & Maan, hereinafter referred to as "the gift card".

1.2 By purchasing or using the gift card, the holder agrees to these terms and conditions.

1.3 Bij Daaf & Maan reserves the right to amend these terms and conditions at any time. The most current version can always be consulted on the website. Changes do not apply retroactively to gift cards already sold prior to the change.

2. Purchase and value

2.1 The gift card is available with a value between €10 and €150.

2.2 The gift card is provided with a unique code, which is stated on the physical card.

2.3 After full payment has been received, the gift card is only handed over upon collection in store, at Nieuwe Rijn 49 in Leiden. Shipping is not possible.

3. Using the gift card

3.1 The gift card can be redeemed for products and/or services offered at Bij Daaf & Maan, Nieuwe Rijn 49 in Leiden, unless stated otherwise.

3.2 The gift card can be redeemed by entering the code at checkout.

3.3 If the purchase amount exceeds the balance on the gift card, the difference must be paid by another payment method.

3.4 If the purchase amount is lower than the balance, the remaining amount stays available for a future purchase, until the card expires.

3.5 The gift card cannot be exchanged for cash.

3.6 An unlimited number of gift cards may be used per order.

4. Validity

4.1 The gift card is valid for up to 5 years from the date of issue, unless stated otherwise on the card or confirmation.

4.2 After the expiry date, the (remaining) balance of the gift card lapses, unless prohibited by law.

4.3 Bij Daaf & Maan is not obliged to send a reminder of an approaching expiry date, but may choose to do so as a courtesy.

 

5. Loss, theft and fraud

5.1 The gift card is treated as cash. In the event of loss, theft, or misuse of the code, Bij Daaf & Maan is not obliged to provide compensation or a replacement.

5.2 In case of suspected fraud or unlawful use, Bij Daaf & Maan reserves the right to block the gift card.

 

6. Returns and withdrawal

6.1 Balances already used from the gift card cannot be refunded.

6.2 When returning products that were (partly) paid for with a gift card, the amount will be credited to a new gift card, unless otherwise required by law.

6.3 The statutory right of withdrawal (14-day cooling-off period) applies to the purchase of the physical gift card, unless the card has already been (partly) redeemed. [Please verify this specifically with a legal advisor regarding the rules on the right of withdrawal for gift vouchers.]

7. Liability

7.1 Bij Daaf & Maan is not liable for damage resulting from improper use of the gift card by the holder.

9. Governing law

These terms and conditions are governed by Dutch law. Disputes will be submitted to the competent court in Leiden, unless mandatory law provides otherwise.
